These Terms and Conditions governing the use of Web Services provided by the Abu Dhabi Pension Fund (ADPF) ("General Terms and Conditions, Special Terms and Conditions") shall be read in conjunction with the Terms and Conditions governing Active Member Accounts / Entity Account /Government to Government (G2G) Account with Super user privilege / normal privileges, as applicable. These Terms and Conditions shall be read and understood before using any of the services provided under the ADPF Web Services. These terms shall be regharded as legal binding terms and the customer shall be considered aware of the special terms and conditions of the Web services of the Fund upon the First use of the ADPF Web Services, and if any particular business relationship between the Customer and the ADPF is governed by a separate agreement or specific terms and conditions, that agreement or those specific terms and conditions shall prevail over these Terms and Conditions to the extent that the provisions of that agreement or those specific terms and conditions (as the case may be) conflict with these Terms and Conditions. Any capitalized terms, not otherwise defined herein, shall have the meaning assigned to them in the General Terms and Conditions governing Active Member account or Entity account or G2G account as applicable.

تُقرأ هذه الشروط والأحكام الخاصة باستخدام الخدمات الإلكترونية التي يقدمها صندوق أبوظبي للتقاعد ("الشروط والأحكام العامة", "الشروط والأحكام الخاصة") مع الشروط والأحكام المنظمة لحسابات المؤمن عليه/ وحساب الجهة/ والمعاملات بين الجهات الحكومية/ والحسابات ذات صلاحية المستخدم المسؤول/والصلاحيات الاعتيادية بحسب مقتضى الحال. ويجب قراءة وفهم هذه الشروط والأحكام قبل استخدام أي من الخدمات الإلكترونية التي يقدمها الصندوق. وتعتبر هذه الأحكام ملزمة ويعتبر المتعامل مدركاً للشروط والأحكام الخاصة بالخدمات الإلكترونية بالصندوق بمجرد قيامه بأول استخدام لخدمات الصندوق الإلكترونية، وفيما إذا كانت العلاقة بين الصندوق وأي متعامل يحكمها اتفاق خاص، أو شروط وأحكام معينة، فإن ذلك الاتفاق أو تلك الشروط والأحكام تسود على هذه الشروط والأحكام في حدود ما يقع من تعارض بين تلك الاتفاقية أو الشروط والأحكام مع هذه الشروط والأحكام. وتحمل أية مصطلحات بخط عريض المعاني المخصصة لها في الشروط والأحكام التي تحكم حساب المؤمن عليه أو حساب الجهات أو حساب التعاملات بين الجهات الحكومية بحسب مقتضى الحال ما لم تحمل تعريفاً مغايراً في الشروط والأحكام الماثلة.

The Law: Law No (2) of 2000 regarding the civil retirement pensions and benefits for the Emirate of Abu Dhabi and its amendments.

القانون: القانون رقم (2) لسنة 2000 في شأن معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي وتعديلاته

The Fund or ADPF means Abu Dhabi Pension Fund.

الصندوق: صندوق أبوظبي للتقاعد .

Account: means any Active Member account or Entity account or G2G account registered with Abu Dhabi Government e-Portal, which is opened and maintained in the name of the registered user, for the purposes of present and/or future utilization of the web services provided by ADPF, as identified in the Online Active Member/Entity Registration.

الحساب: حساب أي مؤمن عليه أو جهة أو معاملات بين الجهات الحكومية المسجل في بوابة حكومة أبوظبي والذي يتم إنشاؤه وتحديثه باسم المستخدم المسجل لأغراض الاستخدام الحالي و/أو المستقبلي لخدمات الصندوق الإلكترونية، كما هو مبين في نموذج تسجيل المؤمن عليه/ الجهة عبر الإنترنت.

Authorized Signatory: means any person who has been authorized by the Entity or the Government organization, through duly executed and valid Memorandum and Articles of Association of the Company to sign, and operate the Account on behalf of the Entity or the Government organization including any/all of the ADPF Web Services.

المفوض بالتوقيع: أي شخص تفوضه الجهة أو المنشأة الحكومية بموجب عقد التأسيس أو النظام الأساسي الموقع والنافذ أصولاً، بما يفوضه بالتوقيع عليه، وتشغيل الحساب نيابة عن الجهة أو المنشأة الحكومية بما في ذلك أي/ وكل خدمات الصندوق عبر الإنترنت.

Entity Account: means any one or more Accounts opened and operated by an Entity incorporated in the Emirate of Abu Dhabi in its name with ADPF. Entity Account can be a super user account or normal account. Super user account is identified and registered in the Entity Registration process. Normal accounts are enrolled by super user account of that specific entity.

حساب الجهة: أي حساب أو أكثر تفتحه وتديره أي جهة عمل تأسست في إمارة أبوظبي باسم تلك الجهة لدى الصندوق. ويمكن أن يكون حساب الجهة حساب مسؤول متميز أو حساباً عادياً. ويعرف ويسجل حساب المسؤول المتميز ضمن عملية تسجيل الجهة. وتُسجل الحسابات العادية عن طريق حساب المسؤول المتميز لتلك الجهة.

Super User Account: means the Account with the privilege of registering/enrolling additional accounts constrained to that entity or government and provide the required access for the registered accounts.

حساب المسؤول المتميز: الحساب الذي يتمتع بصلاحية تسجيل/ وإدارة حسابات إضافية تقتصر على تلك الجهة أو الحكومة، ويمنح صلاحية الدخول لتلك الحسابات المسجلة.

Business Day: means any day from Monday through Thursday (excluding official holidays announced by Abu Dhabi Government), being the days which the ADPF will process offline service requests excluding online services.

يوم عمل: أي يوم يقع بين الاثنين والجمعة (باستثناء الأيام التي تعلنها حكومة أبوظبي عطلات رسمية) وهي الأيام التي يقوم فيها الصندوق بالعمل على الطلبات غير المتصلة بالإنترنت وليس خدمات الصندوق عبر الإنترنت.

Customer: means any account user holding Active Member Account with ADPF or any Entity account incorporated in the Emirate of Abu Dhabi or G2G account with ADPF Web Services.

المتعامل: مستخدم أي حساب يحمل حساب مؤمن عليه لدى الصندوق، أو حساب أي جهة تأسست في إمارة أبوظبي، أو أي حساب تعاملات بين الجهات الحكومية لخدمات الصندوق عبر الإنترنت.

Intellectual Property: means the intellectual property rights related to the Services provided under these Terms and Conditions, including but not limited to, all statutory and other proprietary rights in respect of all intellectual property including all trademarks, technical information, process control technology, database rights, information technology, rights related to software and applications, patents, patent applications, logos and devices, confidential information, trade secrets, design rights, copyright and any other similar rights (whether registered or unregistered).

حقوق الملكية الفكرية: الحقوق المتعلقة بالخدمات المقدمة بموجب هذه الشروط والأحكام وتشمل على سبيل المثال لا الحصر كافة الحقوق القانونية وحقوق الملكية الأخرى المتعلقة بأي ملكية فكرية وتشمل العلامات التجارية، المعلومات الفنية، تقنيات رقابة العمليات، حقوق قواعد البيانات، تقنية المعلومات، حقوق متصلة بالتطبيقات، براءات الاختراع، طلبات براءات الاختراع، الشعارات، والأجهزة، المعلومات السرية، الأسرار التجارية، حقوق التصميم، حقوق النسخ، أي حقوق أخرى مشابهة (بغض النظر عن تسجيلها من عدمه).

Password: means the personal identification letters and/or numbers (this would be alphanumerical) and/or special characters selected by the Customer during the online registration process, which allows the Customer to access the ADPF Web Services.

كلمة المرور: حروف و/أو أرقام التعريف الشخصية (ويفترض أن تتكون من مزيج من الحروف والأرقام) و/أو أي حروف خاصة يختارها المتعامل خلال عملية التسجيل عبر الإنترنت تسمح للمتعامل بالدخول إلى خدمات الصندوق الإلكترونية.

Transactions: means usage of any services or function provided by ADPF under the ADPF Web Services, relating to the Customer's Account or other business-related activities.

المعاملات: استخدام أي خدمة أو خاصية يوفرها الصندوق في إطار خدمات الصندوق الإلكترونية، وترتبط بحساب المتعامل، أو أي أنشطة أخرى تتعلق بالأعمال.

ADPF Web Services: means the online web services provided by ADPF from time to time.

خدمات الصندوق الإلكترونية: الخدمات التي يقدمها الصندوق عبر الإنترنت بين حين وآخر.

Disclaimer: means the ADPF Disclaimer, a copy of which is available on the Website's login page.

إخلاء المسؤولية: سياسة إخلاء مسؤولية الصندوق، والمتوفرة على الموقع الإلكتروني.

Privacy Policy: means the ADPF’s Privacy Policy, a copy of which is available at the Website's login page.

سياسة الخصوصية: سياسة الخصوصية التابعة للصندوق وتتوفر نسخة منها على صفحة الدخول إلى الموقع الإلكتروني.

Registration: means enrolment to avail the ADPF Web Services provided by the ADPF. This may be done by duly completing the online Entity Registration / Active Member Registration.

التسجيل: التسجيل بغرض الاستفادة من الخدمات التي يوفرها الصندوق عبر الإنترنت. ويتم التسجيل من خلال تعبئة تسجيل الجهات/ المؤمن عليه عبر الإنترنت أصولا.

Username: means an alphanumerical combination, or the identification numbers, or a combination of both, which is used while registering through Abu Dhabi Government e-Portal, from which ADPF identifies the Customer accessing the ADPF Web Services.

اسم المستخدم: مزيج من الحروف والأرقام، أو الأرقام التعريفية أو مزيج منهما، والذي يستخدم عند التسجيل من خلال البوابة الإلكترونية لحكومة أبوظبي، والذي من خلاله يحدد الصندوق هوية المتعامل الذي يدخل إلى خدمات الصندوق الإلكترونية.

Website: means the ADPF official website www.pension.gov.ae providing access to the ADPF Web Services.

الموقع الإلكتروني للصندوق: الموقع الرسمي للصندوق وهو www.pension.gov.ae والذي يمكن من خلاله الدخول إلى خدمات الصندوق الإلكترونية.

The entity and its representative shall both bear the full legal and financial liability towards the Abu Dhabi Pension Fund for the Active Member Registration.

تلتزم وتتحمل جهة العمل ومن يمثلها المسؤولية القانونية والمالية الكاملة تجاه صندوق أبوظبي للتقاعد عن تسجيل المؤمن عليه.

The entity and its representative recognize that all the information contained in the Active Member Registration Form is correct, they also undertake to bear the complete legal and financial liability in case of providing the Fund with incorrect data or refrains from giving the data stipulated in the law or its executive resolutions or regulations with the intention of unduly obtaining monies from the Fund, according to the text of Article (95) of the law which states that: The entity and its representative recognize that all the information contained in the Active Member Registration Form is correct, they also undertake to bear the complete legal and financial liability in case of providing the Fund with incorrect data or refrains from giving the data stipulated in the law or its executive resolutions or regulations with the intention of unduly obtaining monies from the Fund, according to the text of Article (95) of the law which states that: A penalty of imprisonment for a period not exceeding one month and a fine not exceeding (AED 2,500) two thousand and five hundred dirhams shall be imposed on anyone who intends to give incorrect data or refrains from giving the data stipulated in this law or its executive resolutions or regulations with the intention of unduly obtaining sums from the Fund. The same penalty shall be imposed on whoever deliberately provides incorrect data aimed to not fulfilling the Fund's dues in full. However, under all the circumstances, the court shall issue its verdict which states the refund of the amounts that were unduly disbursed”.

تُقر جهة العمل ومن يمثلها بأن جميع المعلومات المقدمة في استمارة تسجيل المؤمن عليه صحيحة ويتعهدان بتحمُل المسؤولية القانونية والمالية كاملة في حال تزويد الصندوق ببيانات غير صحيحة أو الامتناع عن إعطاء البيانات المنصوص عــليها في القانون رقم 2 لسنة 2000 بشأن معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي وتعديلاته أو القرارات أو اللوائح المنفذة له بقصد الحــصول عــلى أموال من الصندوق دون وجه حــق وذلك استنادا لنص المادة (95) من القانون التي تنص على ما يلي تُقر جهة العمل ومن يمثلها بأن جميع المعلومات المقدمة في استمارة تسجيل المؤمن عليه صحيحة ويتعهدان بتحمُل المسؤولية القانونية والمالية كاملة في حال تزويد الصندوق ببيانات غير صحيحة أو الامتناع عن إعطاء البيانات المنصوص عــليها في القانون رقم 2 لسنة 2000 بشأن معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي وتعديلاته أو القرارات أو اللوائح المنفذة له بقصد الحــصول عــلى أموال من الصندوق دون وجه حــق وذلك استنادا لنص المادة (95) من القانون التي تنص على ما يلي "يعــاقب بالحــبس مدة لا تجــاوز شهـراً واحــداً وبغــرامة لا تزيد عــلى (2500) ألفين وخمسمائة درهم كــل من يتعـمد إعــطاء بيانات غــير صحيحة أو يمتنع عن إعــطاء البيانات المنصوص عــليها في هذا القانون أو القرارات أو اللوائح المنفذة له بقصد الحــصول عــلى أموال من الصندوق دون وجه حــق، ويعــاقب بنفس العقوبة كل من تعـمد عــن طـريق إعـطــاء بيانات غــير صحيحة بقصد عـدم الوفاء بمستحــقات الصندوق كــاملة، وفي جــميع الأحــوال تحكم المحكمة برد المبالغ التي صـرفت بدون وجه حق."

The entity shall adhere to pay the due pension contributions to the Fund in accordance with the issued invoices.

تلتزم جهة العمل بسداد مبالغ الاشتراكات التقاعدية المستحقة للصندوق بما يتطابق مع الفواتير الصادرة عنه.

The entity and its representative shall bear the complete legal and financial liability in case of providing the Fund with incorrect data. They shall both undertake to pay any amounts disbursed by the Fund to the active member or the pensioner as per such incorrect data, according to the text of Article (95) of the law which states that: A penalty of imprisonment for a period not exceeding one month and a fine not exceeding (AED 2,500) two thousand and five hundred dirhams shall be imposed on anyone who intends to give incorrect data or refrains from giving the data stipulated in this law or its executive resolutions or regulations with the intention of unduly obtaining monies from the Fund. The same penalty shall be imposed on whoever deliberately provides incorrect data aimed to not fulfilling the Fund's dues in full. However, under all the circumstances, the court shall issue its verdict which states the refund of the amounts that were unduly disbursed”.

ﺗﺘﺤﻤﻞ ﺟﻬﺔ ﺍﻟﻌﻤﻞ ومن يمثلها المسؤولية القانونية ﻭﺍﻟﻤﺎﻟﻴﺔ الكاملة ﺍﻟﻤﺘﺮﺗﺒﺔ على موافاة الصندوق بأية بيانات ﻏﻴﺮ ﺻﺤﻴﺤﺔ. وتتعهد بتحمل أية مبالغ يتم صرفها من الصندوق للمؤمن عليه أو لصاحب المعاش وفقا لهذه البيانات غير الصحيحة. وذلك استنادا لنص المادة (95) من القانون التي تنص على ما يلي "يعــاقب بالحــبس مدة لا تجــاوز شهـراً واحــداً وبغــرامة لا تزيد عــلى (2500) ألفين وخمسمائة درهم كــل من يتعـمد إعــطاء بيانات غــير صحيحة أو يمتنع عن إعــطاء البيانات المنصوص عــليها في هذا القانون أو القرارات أو اللوائح المنفذة له بقصد الحــصول عــلى أموال من الصندوق دون وجه حــق، ويعــاقب بنفس العقوبة كل من تعـمد عــن طـريق إعـطــاء بيانات غــير صحيحة بقصد عـدم الوفاء بمستحــقات الصندوق كــاملة، وفي جــميع الأحــوال تحكم المحكمة برد المبالغ التي صـرفت بدون وجه حق."

The entity and its representative shall adhere to attach the pledges and acknowledgments related to the disbursement of the end of service lump-sum benefits and the pension within the end of service transaction. Otherwise, the service term will be closed with non- disbursement for the addition purposes and no deductions will be made in favor of the entity.

تلتزم جهة العمل ومن يمثلها بإرفاق الإقرارات الخاصة بصرف مكافأة نهاية الخدمة والمعاش التقاعدي ضمن معاملة نهاية الخدمة وخلافاً لذلك فإنه سيتم إغلاق مدة خدمة المؤمن عليه بعدم الصرف لغايات الضم ولن يتم استقطاع أية خصومات لصالح جهة العمل.

The entity and its representative shall adhere to not disclose any data related to the Fund and the active members at the entity without obtaining the prior approval on such action from the Fund.

تلتزم جهة العمل ومن يمثلها بعدم الإفصاح عن أية بيانات تخص الصندوق والمؤمن عليهم لدى الجهة دون أخذ الموافقة المسبقة لذلك من الصندوق.

For the entity or its representative to make online registration, they shall navigate to login screen of Abu Dhabi Pension Fund e-portal or click on the User registration link on Abu Dhabi Government e-Portal

حتى تتمكن جهة العمل أو من يمثلها من التسجيل عبر الموقع الإلكتروني فإنه يتوجب عليهم الانتقال إلى شاشة الدخول من خلال بوابة الصندوق الإلكترونية، أو الضغط على رابط تسجيل مستخدم على بوابة حكومة أبوظبي.

The entity or its representative shall carefully read and follow the instructions indicated in the online registration form.

يتعين على جهة العمل ومن يمثلها الإمعان في قراءة واتباع التعليمات المبينة في نموذج التسجيل الالكتروني.

At the first login, the entity or its representative shall carefully read the Terms and Conditions governing the ADPF e-services. Accordingly, he shall adhere to it once the box entitled “I agree and accept all the Terms and Conditions” is clicked

عند الدخول للمرة الأولى، يتعين على جهة العمل أو من يمثلها قراءة شروط وأحكام خدمات الصندوق الالكترونية بعناية والالتزام بها بمجرد التأشير على الصندوق المعنون "أوافق على وأقبل كافة الشروط والأحكام"..

A password must be used by the entity or its representative after the completion of the online registration.

عند استكمال التسجيل الالكتروني، يتحتم على جهة العمل أو من يمثلها استخدام كلمة المرور.

The age of the entity’s representative shall be over 21 years.

يجب ألا يقل عمر من يمثل جهة العمل عن 21 عاما.

The entity’s representative must have a valid UAE resident visa if he/she is an expat.

يجب أن يكون لدى من يمثل جهة العمل تأشيرة إقامة سارية المفعول إن كان من غير المواطنين.

Usage of Fund's e-services for the authorized purposes only.

استخدام خدمات الصندوق الإلكترونية للأغراض المصرح بها فقط.

Accept the privileges associated with the account and ensure the data and records protection against unauthorized access, misuse, loss, alteration or destruction.

الموافقة على الصلاحيات الممنوحة للحساب، وضمان حماية البيانات والسجلات من الاستخدام غير المصرح به، ومن سوء الاستخدام، والفقد، والتعديل أو التلف.

Not trying to access the unauthorized login to gain higher privileges or access to any other accounts belonging to other individuals or any entity, in order to access the ADPF e-services. Moreover, the entity or its representative shall be prohibited from attempting to access any other authorized service for login.

عدم محاولة الدخول غير المصرح به للحصول على صلاحيات أعلى، أو الدخول إلى أي حسابات أخرى تخص غيره أو أي جهة أخرى، للدخول إلى خدمات الصندوق الإلكترونية. كما لا يجوز لجهة العمل أو من يمثلها محاولة الدخول إلى أي خدمة أخرى لا يصرح لهم بالدخول إليها.

Not to use ADPF e-services as a staging ground to hack any other systems

عدم استخدام خدمات الصندوق الإلكترونية كأساس مرحلي لكسر حماية أي أنظمة أخرى.

Not to use ADPF e-services through any unauthorized Internet access methods.

عدم استخدام خدمات الصندوق الإلكترونية عبر طرق غير مشروعة للدخول إلى الإنترنت

Refrain from using ADPF e-services for any illegal or any personal interests.

الامتناع عن استخدام خدمات الصندوق على الإنترنت لأي أغراض غير مشروعة، أو لأي مصالح شخصية.

In case the entity or its representative discovers any potential vulnerability/ security gap/ or weakness on any of ADPF e-services, it shall be reported to the concerned ADPF’s call center – e-services team. Moreover, they are prohibited from using any such vulnerability/ security gap/ or weakness and shall bear all legally liability towards such acts.

إبلاغ مركز الاتصال المعني لدى الصندوق – فريق الخدمات عبر الإنترنت عن أي احتمال لقابلية الهجوم/ أو ثغرة أمنية/ أو ضعف في أي من خدمات الصندوق الالكترونية، ويُحظر على جهة العمل ومن يمثلها تحت طائلة المسؤولية القانونية استغلال أي قابلية للهجوم/ أو الثغرات الأمنية أو أوجه الضعف.

Using ADPF Web Services through the customers’ accounts provided by Abu Dhabi Government e-Portal; selecting safe passwords and maintaining its safety and ensuring its protection.

استخدام خدمات الصندوق الالكترونية باستخدام حسابات المتعاملين التي يحصل عليها من البوابة الإلكترونية لحكومة أبوظبي، واختيار كلمات سر آمنة، والحفاظ عليها بأمان، وضمان حسن حمايتها.

Being fully aware that the information/ data handled through ADPF e-services are classified as CONFIDENTIAL. Accordingly, all the necessary measures to ensure the information protection shall be taken.

إدراك وفهم بأن المعلومات/ والبيانات التي يتم التعامل معها عن طريق خدمات الصندوق الإلكترونية مصنفة على أنها سرية واتخاذ كافة التدابير اللازمة لحماية هذه المعلومات.
